Terms of Service

Article 1 — Purpose of the Service

TOPSPAWN is an online directory allowing players to discover, list and vote for video game servers (Minecraft, FiveM, Garry's Mod, Rust, SCUM, etc.). These Terms of Service (ToS) govern access to and use of the topspawn.com website.

By accessing the website or creating an account, you unconditionally accept these Terms of Service. If you do not accept these terms, please do not use the website.

Article 2 — Registration

Registration is free and open to any individual aged at least 13 years. Minors under 13 years of age are not permitted to create an account.

Upon registration, the user provides a username, a valid email address and a password. The user agrees to provide accurate information and to keep it up to date.

Each user is responsible for maintaining the confidentiality of their login credentials. Any activity carried out from their account is presumed to be their own.

Article 3 — Server Listings

Registered users may submit game servers to the directory. Each submission is subject to review by the moderation team prior to publication.

The user agrees to:

• Only list servers for which they are the owner or an authorized administrator
• Provide accurate information (name, IP address, description)
• Not publish misleading or fraudulent content
• Not use automated systems to manipulate votes
• Comply with the limit of 5 servers per free account

Article 4 — Prohibited Content

The following content is strictly prohibited on TOPSPAWN:

• Illegal, defamatory, abusive or discriminatory content
• Pornographic or excessively violent content
• Promotion of cheating software, hacks or exploits
• Spam, unsolicited advertising or malicious links
• Impersonation of individuals or brands
• Servers promoting illegal activities (unregulated gambling, etc.)

Article 5 — Moderation and Penalties

The TOPSPAWN team reserves the right to moderate, modify or remove any content that does not comply with these Terms of Service, without prior notice or compensation.

In the event of a breach, the following penalties may be applied:

• Warning by email
• Removal of the relevant content
• Temporary account suspension
• Permanent account deletion

TOPSPAWN is not required to justify its moderation decisions but will endeavor to do so where possible.

Article 6 — Intellectual Property

All elements of the website (design, logo, text, source code) are the property of TOPSPAWN. Game names, logos and trademarks mentioned belong to their respective owners.

By publishing content on TOPSPAWN (descriptions, images), the user grants a non-exclusive, royalty-free, worldwide license to display that content on the website as part of the service.

Article 7 — Limitation of Liability

TOPSPAWN is a directory and does not operate the listed game servers. Accordingly, TOPSPAWN shall not be held liable for:

• The content, quality or availability of the listed servers
• Damages resulting from the use of a listed server
• Temporary service interruptions due to maintenance or technical issues
• Data loss in the event of force majeure

The website is provided "as is", without warranty of any kind.

Article 8 — Amendments to the Terms of Service

TOPSPAWN reserves the right to amend these Terms of Service at any time. Users will be notified of material changes via a notice on the website or by email.

Continued use of the website following any amendment constitutes acceptance of the revised terms.

Article 9 — Governing Law

These Terms of Service are governed by French law. In the event of a dispute, French courts shall have exclusive jurisdiction, following an attempt at amicable resolution.
