General Terms and Conditions of Sale

Article 1 — Purpose

These General Terms and Conditions of Sale (GTC) govern the sale of paid services offered on the topspawn.com website. By placing an order, the Buyer unconditionally accepts these GTC.

Article 2 — Services and Pricing

TOPSPAWN offers various paid plans for server owners. Details and current pricing are available on the Boost page of the website (topspawn.com/boost). TOPSPAWN reserves the right to modify plans and pricing at any time. The applicable terms are those in force at the time of the order.

Article 3 — Order and Payment

Payment is secure and processed by Stripe. The Buyer must hold a TOPSPAWN account and be the owner of the relevant server. The order is confirmed upon payment validation. Stripe is responsible for processing banking data in accordance with its own privacy policy.

Article 4 — Service Activation and Delivery

Services are activated immediately upon payment confirmation. The Buyer is notified by email and by a notification in their member area.

Article 5 — Right of Withdrawal

Pursuant to Article L221-28, paragraph 13 of the French Consumer Code, the right of withdrawal may not be exercised for contracts for the supply of digital content not provided on a tangible medium, the performance of which has begun with the consumer's prior express consent and acknowledgment of the loss of their right of withdrawal.

By confirming their order, the Buyer expressly acknowledges and agrees that:

• Service delivery begins immediately upon payment confirmation
• They have expressly consented to this immediate delivery
• They accordingly waive their 14-day right of withdrawal

Article 6 — Refunds

No refunds are provided once the service has been activated, given the waiver of the right of withdrawal. In the event of a proven technical failure attributable to TOPSPAWN, TOPSPAWN undertakes to rectify the issue as soon as possible or, failing that, to refund the unused period.

Any complaint must be submitted to contact@topspawn.com within 7 days of identifying the issue.

Article 7 — Term and Renewal

Recurring subscriptions are renewed automatically. The Buyer may cancel at any time from their member area or via the Stripe customer portal. Cancellation takes effect at the end of the current period, with no pro-rata refund.

One-time permanent purchases require no renewal. Time-limited offers expire automatically at the end of the stated period.

Article 8 — Termination

TOPSPAWN reserves the right to suspend or terminate access to paid services in the event of a breach of the Terms of Service, fraud or abuse, without refund.

The Buyer may cancel their subscriptions at any time via the Stripe portal accessible from their dashboard.

Article 9 — Liability

TOPSPAWN undertakes to provide the described services with due diligence. TOPSPAWN shall not be held liable for temporary interruptions due to maintenance or force majeure circumstances.

Article 10 — Personal Data

Data collected in connection with purchases is processed in accordance with the Privacy Policy. Stripe processes banking data as a sub-processor in accordance with its own privacy policy.

Article 11 — Governing Law and Disputes

These GTC are governed by French law. In the event of a dispute, the parties agree to seek an amicable resolution. Failing that, French courts shall have exclusive jurisdiction.

In accordance with Articles L611-1 and R612-1 of the French Consumer Code, the Buyer may have free recourse to a consumer mediation service.
